当該建設業者は、管工事等の建設工事を営み、A氏は同社の取締役として、業務全般を統括管理する者であるが、令和７年２月１日、元請負業者から請け負った大阪府茨木市内の水道管布設工事において、同社の労働者が道路路肩の清掃作業中、加療約２か月を要する負傷をし、４日以上休業することになり、遅滞なく、茨木労働基準監督署長に労働者死傷病報告を電子情報処理組織を使用して報告しなければならないのに、A氏はこれを行わなかった。このことで、同社及びA氏は、労働安全衛生法（昭和47年法律第57号）違反により、それぞれ罰金20万円の刑に処せられ、令和８年４月25日にその刑が確定した。
