合同会社翔榮（以下「本件建設業者」という。）の代表社員である佐久間翔太は、本件建設業者の業務に関し、令和５年５月２７日、産業廃棄物収集運搬業務を営む事業者に対し委託契約を書面により行わないで、千葉県船橋市内の物置撤去工事から排出される産業廃棄物である木くず約３トンの運搬を含む解体工事一式を代金４０万円で委託した。 当該事実に基づき、土浦簡易裁判所から令和８年５月１９日付け令和８年（い）第１３６号略式命令において、本件建設業者及びその代表社員である佐久間翔太は、廃棄物の処理及び清掃に関する法律違反により、それぞれ罰金５０万円の刑に処された。 このことが、建設法第２８条第１項第３号及び同条第３項に該当する。
