当該建設業者は、Aから一級建築士免許証の写しを受け取り、その写しを添付して令和３年10月11日に提出した建設業法第17条において準用する同法第11条第１項及び第４項の変更届出書及び書面に、同法第17条において準用する同法第11条第１項及び第４項の規定に違反して、当該建設業者が同人を雇用していないにもかかわらず、同月9日に同人を同法第15条第２号に規定する専任の技術者として当該建設業者の営業所に配置したとする虚偽の記載をした。
