１ 当該建設業者は、令和６年１月下旬に、A氏と面談し、建設業の許可を受けるため、同人に第一種電気工事士免状の提示を求め、次の条件で、同人と雇用契約を締結した。 ①担当する業務内容 現地調査及び電力申請に必要な書類作成 ②就業場所 会社が指定する場所 ③労働時間 定めず。 ④報酬は月額面10万円（ここから社会保険料は控除、税金は控除せず。） ⑤雇入日 令和６年２月１日 ⑥雇用期間 令和６年２月１日～ ⑦その他 令和６年４月まで自宅待機（それまで担当する業務なし） 当該建設業者は、A氏を雇入れ後、同人に毎月10万円から社会保険料を控除した額の報酬を支払っていたものの、同人に仕事を与えず、その結果、同人は当該建設業者の業務を行わずに自宅待機をする状態が続いた。そのような状態を継続させたまま、令和６年6月初旬に同人に解雇を予告し、同月末日をもって同人は当該建設業者を退職した。 ２ 当該建設業者は、令和６年３月21日に提出した建設業法第５条の許可申請書及び同法第６条第１項の書類に、１のとおり、A氏は営業所に常勤して専ら職務に従事することを要するものではなく、すなわち、専任の者ではなく、かつ、営業所に置いている者でもなかったにもかかわらず、同氏を同法第７条第２号に規定する専任の技術者として当該建設業者の営業所に置いているとの虚偽の内容を記載し、同年４月12日に電気工事業に係る同法第３条第１項の一般建設業の許可を受けた。
