高垣工務店代表の高垣克弘は、西牟婁郡上富田町朝来所在の木造家屋新築工事を請け負い、高垣和弘はその工事現場の責任者として、労働者を指揮監督して工事の施工管理業務を行うとともに労働者の安全を管理する立場にあった。令和2年8月1日、同現場において、現場労働者に建造物の周囲に仮設した高さ4.76メートルの一側足場の上で軒下の裏地処理のための計測作業を行わせるにあたり、躯体と当該足場の間には幅41センチメートルの開口部があり、墜落により現場労働者に危険を及ぼす恐れがあり、かつ、作業床の端部に手すりを設けることが容易であったにもかかわらず、その措置を講じず、現場労働者が墜落するおそれのある場合に係る危険を防止するために必要な措置を講じなかった。結果、現場労働者1名が足場から墜落し、大けがを負った。そのため、高垣克弘は労働安全衛生法違反により和歌山簡易裁判所から罰金20万円の略式命令を受けた。このことは、建設業法第28条第1項第3号に該当すると認められる。
