当該建設業を営む者は茨木市内の民間発注工事（以下、「本件工 事」という。）において、建設業法第26条第1項及び第2項の規定に違反して、資格要件を満たさない直接的かつ恒常的な雇用関係のない者を監理技術者等として工事現場に配置した。 また、本件工事において、建設業法第22条第1項の規定に違反して、その請け負った建設工事を一括して株式会社一六八建設に請け負わせた。 さらに、本件工事において、建設業法第16条の規定に違反して、同法第3条第1項第2号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を同社等と締結するとともに、本件工事及び大阪市内の民間発注工事において、建設業法第3条第1項の規定に違反して同項の許可を受けないで建設業を営む同社と下請契約を締結した。 その上、当該建設業を営む者は、他の大阪市内の民間発注工事において、建設業法第26条第1項の規定に違反して、工事現場に主任技術者を配置しなかった。
