The disposed party, 株式会社ＲＥＲＩＳＥ, entered into sales contracts for newly built houses for which it was the seller and delivered the houses. Under the Act on Securement of Execution of Specific Housing Defect Liability (Act No. 66 of 2007; “Housing Defect Liability Execution Act”), it was required to take financial capacity securing measures by each reference date. However, it did not take such measures for 20 cases as of the reference date of March 31, 2022 and for 131 cases as of the reference date of March 31, 2023. It was also required to file notifications regarding the status of implementation of the financial capacity securing measures within three weeks from each reference date, but it had not filed notifications for 115 units as of the reference date of March 31, 2022 and for 131 units as of the reference date of March 31, 2023. In addition, it concluded 274 sales contracts for newly built houses for which it would be the seller during the period from the day after the relevant reference date until the day on which it received confirmation of the filing. The above conduct violates Article 11(1), Article 12(1), and Article 13 of the Housing Defect Liability Execution Act. Further, with respect to a total of 150 real estate sales contracts between October 16, 2021 and March 26, 2023, regarding the section titled “Overview of Measures Concerning Execution of Housing Defect Liability” in the important matters explanation document, although there was no insurance contract, it described that it was insured and provided an explanation, and also delivered an Article 37 document that described that it was insured. The above conduct violates Article 35(1)(13) and Article 37(1)(11) of the Real Estate Transaction Business Act.
