Kashima Road Co., Ltd. carried out the 'Heisei 27 Fiscal Year No. 1 Toyohashi Kawaramachi Electric Cable Joint Ditch Nishi-Shinmachi Construction' ordered by the Chubu Regional Development Bureau, but it was found that in some parts of the paving work, an asphalt mixture different from that specified in the design documents was used in the base layer.

The operator used asphalt mixture containing recycled aggregate instead of the specified new aggregate in construction projects ordered by the Hokuriku, Chubu, Kinki, Chugoku, and Kyushu Regional Development Bureaus. Although the contract documents specified the use of new aggregate asphalt mixture, investigations by the Ministry of Land, Infrastructure, Transport and Tourism revealed that the operator used recycled aggregate asphalt mixture without prior consultation with the client. The operator's mixture plant manager was aware that the asphalt mixture shipped should be new asphalt mixture, but recognized it as recycled asphalt mixture. The operator also shipped asphalt mixture containing recycled aggregate to contractors for projects ordered by multiple regional bureaus, explicitly indicating on shipping slips that the mixture was new asphalt mixture, despite using recycled aggregate asphalt mixture. It was confirmed that the operator knowingly used recycled asphalt mixture and misrepresented it as new asphalt mixture in shipping documents.
