K.K. Orientozu

The construction company, headquartered in Osaka City and engaged in construction contracting, was the client for a new building construction project located in Osaka City. Worker A, an employee of the company responsible for overseeing construction and worker safety, was involved in the work. On June 28, 2022, at the construction site, A permitted worker B, employed by another contractor responsible for the construction, to perform painting of the building's bargeboard. Specifically: 1. When allowing the use of the sixth-tier scaffold board on the east side of the building as a work platform, the platform was approximately 9 meters above ground, and did not have enclosing barriers, handrails, or covers, despite the fact that such safety measures could have been easily installed. 2. When allowing the use of the same scaffold board as a work platform, no safety equipment was provided to enable workers to ascend and descend safely. 3. When using a steel pipe scaffold on the east side of the building, the scaffold lacked wall ties or bracing at intervals of five meters vertically and 5.5 meters horizontally, and did not conform to the standards set by the Ministry of Health, Labour and Welfare, thereby failing to prevent potential worker falls. The company failed to take necessary measures to prevent occupational accidents related to these unsafe conditions. Consequently, the company was penalized for violating the Industrial Safety and Health Act (Law No. 57 of 1972) and was fined 500,000 yen. The penalty was finalized on December 22, 2023.
