Labour-law violation当該人の従業員である被災者は、令和8年1月26日午前9時45分頃、市発注の重要インフラ周辺森林保全整備事業(永田・大関線工区)森林整備業務委託の施工場所(二本松市上葉木坂地内)において、重機の移動中、周囲の立木を確認するためにキャビンから身を乗り出した際、誤って体で操作レバーを倒して重機が旋回し、近接の立木とキャビンとの間に頭部を挟まれた。さらに、旋回した重機の先端部(グラップル)が立木に当たって停止した際に、被災者は車外に投げ出された。その後、病院に搬送され、同日午前11時15分に死亡が確認された。令和8年6月22日に福島労働基準監督署より、常時10人以上の労働者を使用しているにもかかわらず、安全衛生推進者を選任していなかったことから、労働安全衛生法に違反したとして、是正勧告を受けた。上記事実行為は、二本松市建設工事等入札参加資格制限措置要領別表措置基準(別表第1第7項第2号ロ)に該当し、本案件が制限措置期間中(令和8年1月21日から令和8年2月20日まで)の事故であったことから、二本松市建設工事等入札参加資格制限措置要領第4条第2項第2号に該当するため。
