Licensing-law violation指名停止等措置要領(工事) 別表2第13号 (建設業法違反行為) いわき緑化興業株式会社は、平成30年8月から平成31年3月に施工した福島県 発注工事において、請負金額が建設業法施行令で定める金額(3,500万円)以上で あるため、現場に配置する主任技術者は専任でなければならないにも関わらず、 営業所に常勤して専らその職務に従事すべき営業所の専任技術者を配置してい た。このことが、建設業法第7 条第2号及び第26条第3 項に違反するとして、令和2 年12月24日に建設業許可部局である福島県知事から指示処分を受けた。このこ とは、「工事請負契約等に係る指名停止等措置要領」(平成13年1月6日付け環 境会第9号大臣官房会計課長通知)別表2第13号に該当するため当該事業者に 対して指名停止を行うものである。
