Fraud or false representationまで (全国) 指名停止等措置要領(物品) 別表第2第14号 (不正又は不誠実な行為) 新宿御苑管理事務所が発注する「新宿御苑廃棄物リサイクル処理等業務」において、処理を受 託した産業廃棄物を、積替え保管の届出を行っていない所在地にて積替え保管を行い、また、受 託した産業廃棄物の処分を終了していないにもかかわらず、産業廃棄物管理票に虚偽の記載を 行い、排出事業者である環境省新宿御苑管理事務所に送付していた事実が東京都環境局多摩 環境事務所の検査により明らかとなった。このことが産業廃棄物処理業の事業の範囲を変更す る取扱いを定めた廃棄物処理法第14条の2第3項において準用する同法7条の2第3項の規定 に違反しており、また、産業廃棄物管理票の取扱いを定めた同法第12条の4第3項の規定に違 反していたため、東京都より4月7日付けで5月12日~6月10日の間事業の全部停止を命ずる 行政処分が行われたことを受け、履行期限までの継続した業務遂行ができないことから、令和2 年5月20日付けで新宿御苑廃棄物リサイクル処理等業務に係る契約の全部を解除したため。
