Antimonopoly violation公正取引委員会は、平成１６年１０月、関東地方整備局、近畿地方整備局及び福島県が発注するプレストレスト・コンクリート工事による橋梁新設工事について、受注価格の低落防止等を図るため、受注予定者を決定し、受注予定者が受注できるようにすることにより、同工事の取引分野における競争を実質的に制限し、改正前の独占禁止法第３条（不当な取引制限の禁止）の規定に違反する行為があったとして、入札参加者に対し排除勧告を行った。しかし、これに全社が応諾しなかったことから、同委員会は、同年１１月１８日、審判開始決定を行い、審判手続を行ってきたところ、平成２２年９月２１日、文部科学省の有資格登録業者７社を含む１１社に対し、平成１７年法律第３５号による 改正前の独占禁止法第５４条第２項又は第３項の規定に基づき、審判審決を行った。 また、今回指名停止を措置する７社以外の４社については文部科学省に有資格登録がなされていない。
