Fraud or false representationまで (関東地方環境事務所管内) 指名停止等措置要領(物品) 別表2第14号 (不正又は不誠実な行為) 株式会社プロルート丸光の元代表取締役は、代表取締役だった令和3年6月、 当時ジャスダック上場だった同社の同年3月期連結決算で、架空の売り上げを計 上し、虚偽の連結損失計算書を記載した有価証券報告書を近畿財務局に提出し たとして、令和5年10月12日、金融商品取引法違反容疑で東京地検特捜部に 逮捕された。 このことが、物品の製造契約、物品の購入契約及び請負契約に係る指名停止等 措置要領別表2第14号(不正又は不誠実な行為)に該当すると認められるた め。 福島地方環境事務所が発注し、鹿島・東急特定建設工事共同企業体が受注し た「令和4年度大熊町特定復興再生拠点区域被災建物等解体撤去等及び除染 等工事(その6)において、当該工事により発生した解体廃棄物の一部が1次下 請人作業員等により、指定の仮置場に運搬されず、不正に持ち出され換金され ていたことについて、窃盗罪の疑いがあるとして、令和5年10月27日、作業員 等4名が書類送致された。 設計図書に従い法令を遵守して契約が履行されなかったことは、「工事請負契約 等に係る指名停止等の措置要領」(平成13年1月6日付け環境会第9号大臣官 房会計課長通知)別表1第4号に該当する。 11 令和5年10月31日から令和5年12月11日まで (福島地方環境事務所管内) 指名停止等措置要領(工事) 別表1第4号 (契約違反)
