East Tech Co., Ltd., a construction contractor authorized under Nagano Prefecture permit number (general-4) No. 025429, was involved in a safety violation incident at a construction site in Nagano City on February 28, 2022. An employee, designated as A, was responsible for overseeing worker safety at the site. During operations involving a drag shovel (a type of construction machinery), a fatal accident occurred when worker C was struck by the shovel's bucket during a concrete gravel compaction task, resulting in death. The incident was attributed to the company's failure to implement adequate safety measures, such as placing a guide or restricting access within the operating zone, despite the risk of contact with moving machinery. As a result, both the company and employee A received summary orders for fines of 200,000 yen and 150,000 yen respectively, for violations of the Labor Safety and Health Act. This incident falls under Article 28, Paragraph 1, Item 3 of the Construction Business Act. The prefectural authority, Nagano Prefecture, issued an instruction on March 1, 2023, requiring the company to take measures to prevent recurrence, including promptly informing staff of the violations, strengthening safety management systems, and conducting ongoing training and education on legal compliance for construction safety.
