Yugen Kaisha Hosokawa Denko violated the Construction Business Act (Article 28, Paragraph 1) by assigning chief engineers to projects in Echizen Town in 2024 and 2022 without proper compliance. During the 2024 Echizen Town project, the company failed to assign a dedicated technical engineer during the construction period, instead assigning chief engineers to two other projects ordered by Fukui Prefecture, in violation of Article 26, Paragraph 3. Additionally, some of these engineers were also assigned as site agents, which was not permitted for the Echizen Town project, constituting a breach of contract (duty for on-site presence). In the 2022 project, the company assigned a full-time dedicated technical engineer at the office as the chief engineer, which also violated the same legal provisions. The Fukui Prefecture has ordered the company to take measures including promptly informing staff of the violations, implementing training to ensure compliance with relevant laws, and reviewing and strengthening internal management systems.
