The representative director of Nagata Construction Co., Ltd. failed to implement necessary safety measures, such as requiring workers at a demolition site in Kashiwa City, Nara Prefecture, to use fall prevention equipment, in relation to safety management of the demolition work. As a result, he was sentenced to a fine for violating the Industrial Safety and Health Act, and the judgment was finalized. This is recognized as applicable under Article 28, Paragraph 1, Item 3 of the Construction Business Act.

On February 11, 2021, at a construction site contracted by Nagata Kensetsu Co., Ltd., a worker was killed when a block fell during stacking work. The company and its employee were each issued a summary order of a 200,000 yen fine by the Kumamoto Summary Court for violations of the Labor Safety and Health Act, which was finalized on April 7, 2022. This is deemed to fall under Article 28, Paragraph 1, Item 3 of the Construction Business Act.

The law to partially amend the Construction Business Act (Act No. 55 of 2014) established a transitional measure that regarded technicians of demolition and earthwork construction businesses, established before the law's enforcement, as technicians of demolition construction businesses until June 30, 2021. This transitional measure has ended, and as of that date, the company no longer meets the standards listed in Article 7, Item 2 of the Construction Business Act.
