The construction company, in cooperation with other businesses, decided the supply schedule for specific elevator-type PS installation work after June 29, 2017, to prevent a decline in supply prices. By doing so, it effectively restricted competition in the construction transaction field, contrary to public interest. The Fair Trade Commission determined this violated Article 3 of the Act against Unjustifiable Premiums and Misleading Representations, and issued an order for exclusion and a surcharge payment. This is recognized as corresponding to Items 2 and 3 of Paragraph 1, Article 28 of the Construction Business Act.

上記の建設業者は他の事業者らと共同して、特定エレベーター方式ＰＳ設置工事について、平成２９年６月２９日以降、供給価格の低落防止等を図るため、供給予定者を決定し、供給予定者が供給できるようにすることにより、公共の利益に反して、工事の取引分野における競争を実質的に制限していた。これが私的独占の禁止及び公正取引の確保に関する法律（昭和２２年法律第５４号）第３条に違反するものと認定され公正取引委員会から排除措置命令及び課徴金納付命令を受けた。 このことが、建設業法第２８条第１項第２号及び第３号に該当すると認められる。
