Itokawa Juki, in the construction work ordered by Shimane Prefecture for the project '(Main) Matsue Kashima Miho Seki Line Prefectural Disaster Recovery Work (4 Disasters, No. 4)', used a vehicle-type construction machine, a drag shovel, to install large sandbags for heavy machinery scaffolding. Despite the risk of danger to workers from contact with the machine, the company did not assign a guide and allowed workers to enter the swing range of the machine. As a result, a worker was caught between the machine and a soil work protective fence and died. The company and its employees were prosecuted by Matsue District Public Prosecutors Office on December 10, 2024, and received a summary order for a fine from Matsue Summary Court on December 13, 2024. This is recognized as a violation of Article 28, Paragraph 1, Item 3 of the Construction Business Act.

（有）糸川重機は、島根県が発注した「（主）松江鹿島美保関線 県単災害復旧工事（４災４号）」において、車両系建設機械であるドラグ・ショベルを用いて重機足場を構築するための大型土のうの設置作業を行うに当たり、同機械に接触することにより労働者に危険が生ずるおそれがあったのに、誘導者を配置せず、労働者を同機械の旋回範囲内に立ち入らせ、その結果、労働者が同機械と土工用防護柵に挟まれ死亡した。 同社及び同社の従業員は、同機械による危険を防止するための必要な措置を講じなかったとして、令和６年１２月１０日付けで松江区検察庁から起訴され、令和６年１２月１３日付けで松江簡易裁判所より罰金刑の略式命令を受けた。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
