有限会社松瀬工務店は、令和５年12月14日に建設業法第28条第３項（同条第１項第２号及び第３号該当）の規定により、建設業に係る営業停止の処分を受け、同月28日から翌年12月27日までの１年間、公共工事又は補助金等の交付を受けている民間工事について、その営業の停止を命じられていた。 それにもかかわらず、同社は当該営業停止期間中に南木曽町発注の公共工事において、３件の入札行為を行い、内１件は令和６年12月２日付けで新たに建設工事請負契約を締結し施工した。 このことは、建設業法第29条第１項第８号に該当する。
