松本装飾株式会社は、管工事業の専任技術者が令和元年10月5日に退社し、令和5年6月27日に管工事業に係る廃業届が提出されるまでの間、建設業法第7条第2号の基準を満たさなくなったことにより許可要件を欠いたまま営業していた。 また、建設業法第7条第2号の基準を満たさなくなった場合、2週間以内に同法第11条第5項に規定する届出書（変更届）を知事に提出しなければならないにもかかわらず、令和5年6月27日に至るまで届出を行わなかった。 さらに、建設業法第7条第2号の基準を満たさなくなった場合、30日以内に同法第12条第5号に規定する届出書（廃業届）を知事に提出しなければならないにもかかわらず、令和5年6月27日に至るまで届出を行わなかった。 このことは、建設業法第7条第2号、同法第11条第5項及び同法第12条第5号に違反し、同法第28条第1項本文に該当する。
