(株)プラスワンサービスは、新潟県妙高市大字関山字妙高山国有林25い林小班内の配管修繕工事の請負人である。 当該工事において、令和５年10月23日に同社の労働者がコンクリート型枠をグラインダーで切断した際に、グラインダーが反発したため、左上腕二頭筋を断裂し、４日以上の休業を要する労働災害が発生した。しかしながら、同社は、遅滞なく労働者死傷病報告書を上越労働基準監督署長に提出しなければならないのに、令和６年２月７日に至るまで、提出しなかった。 このことから、法人及び同社代表取締役が、労働安全衛生法違反により罰金刑（法人20万円、代表取締役20万円）に処され、令和６年11月23日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
