１ 当該建設業者が発注者から請け負った大阪市内の民間発注の建設工事（以下「本件工事」という。）において、建設業法第15条第２号及び第26条第３項の規定に違反して、同号に規定する当該建設業者の営業所における専任技術者を、専任を要する監理技術者として工事現場に配置した。 ２ 建設業を営もうとする者は建設業法第３条第１項の規定により同項の許可を事前に受ける必要があるところ、当該建設業者は、本件工事において、工事着工前に必要な許可を受けてその旨を発注者に伝えていたものの、その許可を受ける前に、入札、見積等の営業行為を行い、設計施工契約（同法第24条の規定により建設工事の請負契約とみなされる。） を請負者として発注者と締結しており、当該建設業者は、同項の規定に違反して同項の許可を受けないで請負代金の額が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。
