１ 無許可業者との下請契約の締結 （１）当該建設業者は、大阪市内の民間発注の工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む菅原組及び安本組と下請契約を締結した。 （２）当該建設業者は、藤井寺市及び西宮市内の民間発注の工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む新居組と下請契約を締結した。 （３）当該建設業者は、尼崎市内の民間発注の工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営む新居組及びA社と下請契約を締結した。 ２ 一括下請負 当該建設業者は、大阪市内の民間発注の工事において、発注者から請け負った建設工事の主たる部分（型枠組立工事）を一括して菅原組に請け負わせて、同者を当該建設業者の現場代理人として配置し、当該建設業者としては適格な主任技術者を配置せず、施工計画の作成、工程管理、品質管理、安全管理、技術的指導、発注者等との協議・調整の全てを当該建設業者が行う必要があるところ、その全ては行っていなかった。 また、当該建設業者は、別の大阪市内の民間発注の工事において、A社から請け負った建設工事の主たる部分（型枠組立工事）を一括して安本組に請け負わせて、同者を当該建設業者の現場代理人として配置し、当該建設業者としては適格な主任技術者を配置せず、施工計画の作成、工程管理、品質管理、安全管理、技術的指導、注文者等との協議・調整等を主として当該建設業者が行う必要があるところ、主としては行っていなかった。 以上のとおり、当該建設業者は、上記の工事において、建設業法第22条第１項の規定に違反して、その請け負った建設工事を一括してそれぞれ菅原組及び安本組に請け負わせた。
