株式会社ハヤミ重機が請け負った解体工事現場において、同社従業員は、工事の現場責任者として、作業に従事する労働者の指揮監督及び安全管理等の業務に従事していたが、解体途中の建物２階で脚立に乗って鉄骨のボルトを取り外す作業を行わせるにあたり、高さ２ｍ以上の作業床の端で、墜落により労働者に危険を及ぼすおそれがあり、かつ、同作業床の端に囲い等を設けることが著しく困難であったことから、労働者に要求性能墜落制止用器具を使用させる等、墜落による労働者の危険を防止するために必要な措置を講じなかったとして、同社及び現場責任者が、尾鷲簡易裁判所から労働安全衛生法違反により、それぞれ罰金２０万円の略式命令を受け、令和７年９月２７日にその刑が確定している。 このことは、建設業法第２８条第１項第３号に該当すると認められる。
