（株）轟組が請け負った四国地方整備局土佐国道事務所発注の「令和３年度南国安芸道路西野地区改良第２外工事」において、令和３年１２月４日、クレーンでつるした木製の型枠５枚（計１００キロ）が落下し、男性作業員に当たる事故が発生したにもかかわらず、労働基準監督署の立入調査において、労働災害は発生していない旨の虚偽の陳述を行った。 本件については、法人としての轟組、土木部副部長、現場代理人が令和４年１２月１５日に高知簡易裁判所より労働安全衛生法違反で略式命令を受け、その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
