Fujita Building Maintenance Co., Ltd. was involved in an incident on August 21, 2021, in Uda Town, Ayauta District, Kagawa Prefecture, during an inspection of a factory slate roof at the request of a client. One worker climbed onto the roof and fell to his death after stepping through the slate roof. The roof was approximately nine meters above ground, and despite the risk of falling through the roof, no measures such as installing a walkway board wider than 30 centimeters were taken to prevent the worker from falling through. The company failed to take necessary safety measures to prevent falls and neglected its duty of care to prevent such accidents. As a result, the worker fell through the roof and died. On March 3, 2022, the Takamatsu Summary Court sentenced the company to a fine of 300,000 yen for violations of the Industrial Safety and Health Act, and one employee was fined 500,000 yen for violations of the same law and for occupational negligence resulting in death. フジタビルメンテナンス株式会社が注文者から依頼を受けた香川県綾歌郡宇多津町における工場スレート屋根の雨漏り箇所の点検作業において、令和３年８月２１日、屋根上に上がった労働者1名が、スレート屋根を踏み抜き、墜落し死亡する事故が発生した。 同屋根は地上から約９メートルの高さにあり、スレート屋根の踏み抜きにより墜落する危険があったにも関わらず、幅３０センチメートル以上の歩み板を設け、踏み抜きによる労働者の危険を防止する等措置を講じていなかった。また、墜落防止のための必要な措置を講じ、墜落事故の発生を未然に防止すべき業務上の注意義務があるのにこれを怠り、労働者に同点検を行わせた過失により、スレート屋根を踏み抜き地上に墜落させ、死亡させた。 これらのことから、令和４年３月３日に高松簡易裁判所より、同社は労働安全衛生法違反により罰金３０万円、同社社員１名は労働安全衛生法違反及び業務上過失致死により罰金５０万円の略式命令を受け、それぞれその刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
