池澤重機は、令和2年2月21日、大阪市淀川区所在の解体工事において、労働者に高さ5メートル以上の鉄骨造の解体の作業を行わせるにあたり、法令で定める建築物等の鉄骨の組立て等作業主任者技能講習を修了した者のうちから、建築物等の鉄骨の組立て等作業主任者を選任しなかった。労働者が、ガス切断機を用いて鉄骨の溶断作業をしていた際、溶断時に発生した火花が建築部材に引火して火災が発生し、労働者が火傷を負って2か月後に死亡した。このことにより、労働安全衛生法第14条、労働安全衛生法施行令第6条、及び労働安全衛生規則第517条の4違反に問われ、大阪簡易裁判所から罰金20万円処する旨の略式命令を受け、令和3年6月18日に当該略式命令が確定した。 このことは、建設業法第28条第1項第3号に該当すると認められる。
