有限会社佐藤建設工業の元代表取締役（令和２年９月１日以降は、元取締役）は、沼田市が令和元年８月２日に執行した「農業集落排水事業多那・二本松地区汚水管埋設工事」の指名競争入札に関し、同市元職員から同入札に関する秘密事項である同工事の予定価格の教示を受け、同社に同予定価格に近接する金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 また、同元代表取締役は、沼田市が令和２年１０月１５日に執行した「白沢簡易水道送水管布設替工事」の条件付き一般競争入札に関し、同市元職員から同入札に関する秘密事項である同工事の予定価格及び最低制限価格の教示を受け、同社に同最低制限価格である金額で入札させて同案件を落札させ、もって偽計を用いて、公の入札で契約を締結するためのものの公正を害すべき行為を行った。 これにより、前橋地方裁判所から令和３年４月１６日に懲役１年(執行猶予３年)の判決を受け、その刑が確定した。 このことが、建設業法第２８条第１項第２号及び第３号に該当し、同条第３項に基づき営業停止処分とする。
