株式会社弘進テックの元代表取締役は、同社の業務に関し、架空の外注加工費を計上するなどの方法により所得を秘匿した上、平成27年11月１日から平成28年10月31日まで、平成28年11月１日から平成29年10月31日まで及び平成29年11月１日から平成30年10月31日までの三事業年度において、虚偽の法人税及び地方法人税確定申告を行う不正の行為により法人税及び地方法人税を免れた。また、架空の課税仕入れを計上するなどの方法により、平成27年11月１日から平成28年10月31日まで、平成28年11月１日から平成29年10月31日まで及び平成29年11月１日から平成30年10月31日までの三事業年度において虚偽の消費税及び地方消費税の確定申告を行う不正の行為により消費税及び地方消費税を免れた。これにより令和５年１月12日長崎地方裁判所から同社元代表取締役は懲役１年６か月（執行猶予３年）の判決を受け、同社は罰金2500万円の判決を受け、各々その刑が確定している。 このことが、建設業法第28条第１項第３号に該当すると認められる。
