有限会社不二園が一次下請として請け負ったあま市甚目寺地内にある甚目寺小学校の樹木剪定等業務の現場責任者は、同社の業務に関し、令和3年3月22日、同校校庭において、労働者に剪定作業を行わせるに当たり、同作業は地面から2メートル以上の箇所で行う作業であって、墜落により労働者に危険を及ぼすおそれがあり、かつ、作業床を設けることが困難であったのであるから、防網を張り、労働者に要求性能墜落制止用器具を使用させる等墜落による労働者の危険を防止するための措置を講じなければならないのに、その措置を講じず、もって労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じなかったものである。 このことが、労働安全衛生法に違反し、津島簡易裁判所より、法人及び現場責任者が罰金20万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第1項第3号に該当する。
