株式会社ディーエス産業の元代表取締役は、同社の業務に関し、架空の外注費を計上する等の方法により所得を秘匿した上で平成２６年４月１日から平成２７年３月３１日までと平成２７年４月１日から平成２８年３月３１日までの二事業年度において虚偽の法人税確定申告を行うなど不正な行為により法人税及び地方法人税を免れた。 また、架空の課税仕入れを計上する方法により、平成２６年４月１日から平成２７年３月３１日までと平成２７年４月１日から平成２８年３月３１日までの二事業年度において虚偽の消費税及び地方消費税確定申告を行うなど不正な行為により消費税及び地方消費税を免れた。 これにより令和３年１０月４日福井地方裁判所から貴社元代表取締役は懲役１年６月（執行猶予３年）の判決を受け、同社は罰金３７００万円の判決を受け、各々その刑が確定している。 このことが、建設業法第２８条第１項第３号に該当すると認められる。
