有限会社東予商会及び同社の現場責任者は、新居浜市内におけるボイラーの灰出し作業現場において、令和５年３月13日、同社従業員が高さ約22.1メートルの場所から墜落し死亡した事故に関し、墜落により労働者に危険を及ぼすおそれがあり、かつ、同所に墜落防止のための囲い等を設けることが著しく困難であったため、労働者に要求性能墜落制止用器具を使用させるなどの墜落による労働者の危険を防止するための措置を講じなければならなかったにもかかわらず、その措置を講じず、もって労働者が墜落するおそれのある場所に係る危険を防止するため必要な措置を講じていなかったとして、同年12月18日、労働安全衛生法違反の罪により西条簡易裁判所から罰金の略式命令を受け、その刑が確定している。 このことは、建設業法第28条第１項第３号に該当する。
