石黒組株式会社の現場責任者は、令和６年４月１日、愛知県弥富市四郎兵衛１丁目地内所在の橋りょう補修事業県道蟹江飛島線新宝川橋上部補強工事における鋼矢板撤去工事において、法定の除外事由がないのに、前記工事現場において、厚生労働省令で定める危険な業務である最大積載量990キログラムの不整地運搬車の運転業務に被告会社に派遣された労働者をつかせるに当たり、同人に対し、安全衛生特別教育規程で定める不整地運搬車に関する知識等の教育を行わず、もって厚生労働省令で定めるところにより、当該業務に関する安全又は衛生のための特別の教育を行わなかったものである。 このことが、労働安全衛生法に違反し、名古屋簡易裁判所より、法人及び現場責任者が罰金10万円の略式命令を受け、その刑が確定した。 これは、建設業法第28条第１項第３号に該当する。
