大滝建設株式会社は、新潟港（西港地区）第二西防波堤嵩上工事における二次下請負人である。同工事の施工管理及び安全管理を統括していた現場代理人は、同工事の業務に関し、法定の除外理由がないのに、令和３年６月24日、同工事現場において、嵩上コンクリート上面部に支持材を乗せ、その支持材に足場板を吊り下げて、海側側面に設置したつり足場上で、型枠に部材を取り付ける作業を労働者に行わせるにあたり、前記つり足場が海中に転落する危険があり、前記つり足場を固定する措置を講じる等、労働者の労働災害を防止すべき業務上の注意義務があったにも関わらずこれを怠り、必要な措置を講じなかった。このことから、前記つり足場の荷重が海側にかかったことにより、前記つり足場上で作業していた同社従業員２名が、つり足場もろとも海中に転落し、１名が死亡、１名が障害を負った。 このことから、業務上過失致死傷及び労働安全衛生法違反により、同社及び同社現場代理人が罰金刑に処され、令和５年９月12日にその刑が確定している。 このことが、建設業法第28条第１項第３号に該当する。
