当該建設業者は、大阪市内の独立行政法人高齢・障害・求職者雇用支援機構発注の工事において、建設業法第19条の規定に違反して請負契約書を作成しなかったものの、アスモテック株式会社名義の請求書を受けて、同社の代表者の銀行口座に請負代金として、令和3年１月から同年３月までの間に５00万円以上の金額を振り込んでおり、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業を営むアスモテックと下請契約を締結した。
