有限会社髙栄建興は、横浜市保土ヶ谷区における「今井川改修工事（その５）」の下請会社であった。 令和２年12 月11 日、同工事現場において、作業に従事していた同社の労働者がドラグショベルから 河川に転落し、４日以上の休業を要する傷害を負った。 労働者が休業４日以上の負傷をしたのであるから、遅滞なく、労働者死傷病報告書を所轄労働基準監 督署長に提出しなければならないのに、令和３年10 月20 日まで同報告書を提出しなかった。 以上のことが、労働安全衛生法第100 条第1 項及び労働安全衛生規則（昭和47 年労働省令第32 号） 第97 条第１項に違反し、有限会社髙栄建興及び同社代表取締役が罰金刑に処せられた。 このことが、法第28 条第１項第３号に該当する。
