株式会社井上組は、東京都立川市内の公共工事において、令和４年４月21日に発生した労働災害を、自社敷地内の資材置き場で発生した労働災害であるとの労働者死傷病報告書を提出し、労働基準監督署長に虚偽の報告をした。 以上のことが、労働安全衛生法第100条第1項、第120条５号及び第122条並びに労働安全衛生規則（昭和47年労働省令第32号）第97条第１項に違反し、株式会社井上組及び同社代表取締役が罰金刑に処せられた。 このことが、建設業法第28条第１項第３号に該当する
