株式会社高見澤は、土木工事業、とび・土工工事業、舗装工事業及び水道施設工事業を営む他、生コンクリート製品の製造等を営む事業者である。同社のコンクリート事業部小布施工場製造副長であるＡは、小布施工場内（所在地：上高井郡小布施町雁田1262-1）のＤＣ工場の生産管理及びＤＣ工場に所属する労働者の安全管理等を統括するものである。 Ａは、同社の業務に関し、令和４年10月14日、ＤＣ工場において、労働者Ｂに圧縮成形機を使用してコンクリート製品の圧縮成形作業を行わせるに当たり、法及びこれに基づく命令により同圧縮成形機に設けた光線式安全装置が有効な状態で使用されるよう点検及び整備を行わず、もって機械等による危険を防止するため必要な措置を講じなかったものである。 このことにより、株式会社高見澤及びＡは労働安全衛生法違反により各々罰金20万円の略式命令を受け、その刑が確定した。 このことは、建設業法第28条第１項第３号に該当する。
