被処分者は、その従たる事務所である神戸支店において、唯一の専任の宅地建物取引士が令和４年８月３１日に退職し、不在であったにもかかわらず、新たな宅地建物取引士を設置しないままその事務所を移転し、京都支店として新たに開設する旨の届出をおこなった。 その後、この事務所において専任の宅地建物取引士が交代した旨の届出をおこなったが、交代までの間、交代前の専任の宅地建物取引士が在職していたとする届出は事実と異なっていた。この結果、新たに専任の宅地建物取引士を設置する令和６年７月１８日までの間、法の規定に適合しない状態を継続させた。このことは、法第３１条の３第３項の規定に違反し、これは法第６５条第２項第２号に該当する。
