中村建設工業株式会社は、その業務に関し、架空の外注費を計上するなどの方法により所得を秘匿した上、３事業年度において虚偽の法人税及び地方法人税の確定申告をし、同社の法人税及び地方法人税を免れた。また、架空の課税仕入れを計上するなどの方法により、３課税期間において虚偽の消費税及び地方消費税の確定申告をし、同社の消費税及び地方消費税の譲渡割額を免れた。 以上の事実により、令和６年５月13日に東京地方裁判所より、法人税法（昭和40年法律第34号）違反、地方法人税法（平成26年法律第11号）違反、消費税法（昭和63年法律第108号）違反及び地方税法（昭和25年法律第226号）違反で同社は罰金2,700万円の判決が下され、令和６年５月27日その刑が確定した。 このことが、建設業法第28条第１項第３号及び同条第３項に該当する。
