株式会社原工務所は、令和元年１１月５日、江津市渡津町～江津町の「国道９号江川橋外橋梁補修工事」において、２次下請工事業者である有限会社木村建設工業の労働者が、水面から高さ約５メートルの位置にあるつり足場において、投光器で周囲を照らす作業を行わせるにあたり、つり足場の作業床の端に囲いや手すり、覆いを設ける等により、墜落による労働者の危険を防止するために必要な措置を講じなければならなかったにもかかわらず、これを講じなかった結果、有限会社木村建設工業の労働者がつり足場の作業床の端から江の川に墜落し、窒息死する事故を発生させた。この件について、同社及び同社土木課長が松江地方裁判所から、労働安全衛生法違反によりそれぞれ罰金２０万円の判決を受け、令和３年９月７日にその刑が確定した。このことが、建設業法第２８条第１項第３号に該当すると認められる。
