１ 当該建設業者は、建設工事請負契約書（以下「本件請負契約書」という。）（着工金A円、中間金B円、完工金C円）を発注者と交わして、発注者から泉南郡岬町内の民間発注工事（以下「本件工事」という。）を請負代金D円（５００万円以上の金額）で請け負い、発注者より着工金を受領し、工事を着工した。 ２ 当該建設業者は、本件工事とは関連がない廃棄物が混ざった土及び廃棄物を本件工事現場に放置するなどしたため、発注者の意向により、本件工事について、請負代金をA円（５００万円未満の金額）とE円（５００万円未満の金額）に分けて作成された建設工事請負契約書を発注者と交わした。 ３ 当該建設業者は、本件請負契約書に基づいて、中間金B円を発注者に請求したところ、発注者との交渉の結果、工事の内容を変更し、請負代金E円の部分をF円に減額する建設工事請負契約を締結し（A円とF円の合計金額５００万円以上）、発注者より当該変更後の工事の着工金としてG円を受領した。 ４ 以上のとおり、当該建設業者は、本件工事において、建設業法第３条第１項の規定に違反して、同項の許可を受けないで請負代金の額が建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。
