当該建設業者は、株式会社勝竜製作所から請け負った大阪市内の民間発注の工事において、地盤が軟弱であることにより移動式クレーンが転倒するおそれのある場所で、移動式クレーンの転倒を防止するため必要な広さ及び強度を有する鉄板等を敷設せずに移動式クレーンを用いて作業を行ったことにより、当該クレーンがバランスを崩して傾き、建設中の鉄骨と鉄骨を吊り上げ作業中のアームが接触してアームが折れ、その吊り上げ中の鉄骨が建設工事現場周辺の家屋等２棟の屋根に落下し、当該屋根が破損するなど、建設工事を適切に施工しなかったために公衆に危害を及ぼした。当該建設業を営む者は、大阪市内の民間発注工事において、建設業法第３条第１項の規定に違反して同項の許可を受けないで建設業法施行令第１条の２に定める金額以上となる建設工事を請け負った。
