山電株式会社の役員は、代表取締役として、業務全般を統括し、官公庁に対する各種報告等の業務を行うものであるが、令和３年５月19日に、千葉県市原市潤井戸地内の工事現場において従事していた同社の労働者が傷害を負い、４日以上休業したのであるから、遅滞なく、労働者死傷病報告書を千葉労働基準監督署長に提出して報告しなければならないのに、令和４年６月15日まで同報告書を提出せず、もって遅滞なく法令で定める報告をしなかった。 この件について、千葉簡易裁判所は令和６年１月26日に同社及び同社の役員に対し、労働安全衛生法違反に基づき罰金20万円の略式命令を行い、これが確定した。 このことは、建設業法第28条第１項第３号に該当するものと認められる。
