戸沼岩崎建設（株）が１次下請業者として法面工事を請け負った北海道松前郡福島町における幹線林道改良工事において、令和４年９月５日、ロープ高所作業を行っていた２次下請業者の労働者１名が法面から墜落し死亡する事故が発生した。事故が発生した作業場所は高さ約１６．４メートル、傾斜約６６度の箇所で、墜落により労働者に危険を及ぼすおそれがあり、かつ、作業の性質上、足場を組み立てる等の方法により作業床を設けることが困難であったため、労働者に要求性能墜落制止用器具を使用させて墜落による労働者の危険を防止するための措置を講じなければならなかったところ、その措置を講じないまま同作業を行わせたことにより、同社及び同社の役職員が令和５年７月７日に函館簡易裁判所より労働安全衛生法違反で略式命令を受け、その刑が確定している。このことが、建設業法第２８条第１項第３号に該当すると認められる。
