当該建設業者は、令和３年10月22日に提出した建設業法第５条の許可申請書及び第６条第１項の書類（以下「許可申請書類等」という。）において、Ａ氏が、他社に常勤して雇用され、当該建設業者から報酬の支払を受けておらず、当該建設業者の常勤の役員でもなく、当該建設業者の営業所に常勤して専らその職務に従事しないにも関わらず、同人が常勤の役員で建設業法施行規則（昭和24年建設省令第14号）第７条第１号イ（1）に該当する者であり、同法第７条第２号に規定する営業所の専任技術者（以下「営業所の専任技術者」という。）として営業所に置いているなどの虚偽の内容を記載し、また、同月19日に大阪市に提出して同市の受付印が押印された同氏に係る「特別徴収切替届出（依頼）書」を、既に当該届出書を取り下げていたにもかかわらず、同月22日に有効な届出書として許可申請窓口で掲示するなどして、同年11月19日に土木工事業、とび・土工工事業、石工事業、電気工事業、鋼構造物工事業、舗装工事業、しゆんせつ工事業及び水道施設工事業に係る建設業の許可を受けた。 さらに、当該建設業者は、許可申請書類等において、Ｂ氏が、当該建設業者の営業所に常勤して専らその職務に従事しないにも関わらず、営業所の専任技術者として営業所に置いているなどの虚偽の内容を記載し、令和３年11月19日に土木工事業、とび・土工工事業、石工事業、鋼構造物工事業、舗装工事業、しゆんせつ工事業及び水道施設工事業に係る建設業の許可を受けた。 また、当該建設業者は、Ａ氏が、当該建設業者の常勤の役員として職務に従事しておらず、また、当該建設業者の営業所に常勤して専ら職務に従事しておらず、土木工事業、とび・土工工事業、石工事業、電気工事業、鋼構造物工事業、舗装工事業、しゆんせつ工事業及び水道施設工事業に係る建設業法第７条第１号及び第２号に掲げる許可の基準を満たさなくなっていた。さらに、Ｂ氏が、当該建設業者の営業所に常勤して専らその職務に従事しておらず、土木工事業、とび・土工工事業、石工事業、鋼構造物工事業、舗装工事業、しゆんせつ工事業及び水道施設工事業に係る同号に掲げる許可の基準を満たさなくなっていた。
