当該建設業者は、京都府内の民間発注工事（以下「本件工事１」という。）において、ブローカーから紹介を受けて急いで入ってほしいと言われ、実態としては一括の形で、株式会社エムズコーポレーションが発注者から請け負った建設工事のその主たる部分を請け負った。その一か月後に契約を解除するまで株式会社エムズコーポレーションから工事現場における技術的指導等を受けていなかった。 また、同社が配置した監理技術者は、同社の営業所の専任の技術者であり、建設業法第26条第３項の規定に違反していたため、適格な技術者ではなかった。 以上のとおり、当該建設業者は、本件工事１において、建設業法第22条第２項の規定に違反して、株式会社エムズコーポレーションから同社が発注者から請け負った建設工事を一括して請け負った。 また、当該建設業者は京都府内の他の工事（以下「本件工事２」という。）」において、建設業法第26条第1項及び第２項の規定に違反して、資格要件を満たさない直接的かつ恒常的な雇用関係のない者を主任技術者として工事現場に配置した。 さらに、本件工事２において、建設業法第16条の規定に違反して、同法第３条第１項第２号に掲げる区分による許可を受けないで下請代金の額が同号の政令で定める金額以上となる下請契約を株式会社日建等と締結するとともに、同法第３条第1項の規定に違反して同項の許可を受けないで建設業を営む藤岡工務店及び山神工務店と下請契約を締結した。
