(1) 当該建設業者は、大阪市発注の３件の工事（以下「本件工事」という。）において、建設業法第26条第３項の規定に違反して、他の工事現場に専任の主任技術者として配置すべきＡ氏を主任技術者の配置に専任を要する本件工事の工事現場に非専任の主任技術者として配置した。 (2) 当該建設業者は、経営規模等評価の申請において、建設業法第27条の26第２項から第４項までの規定に違反して、「工事経歴書」に本件工事うち２件の工事の工事現場に配置した主任技術者をＡ氏と記載すべきところ、Ｂ氏と記載をし、また、株式会社ケイテックから請け負った当該工事を、建設業法第22条第１項の規定に違反して、一括して株式会社タケムラに請け負わせていたが、当該工事を実質的に行っているとは認められないため当該工事の金額を完成工事高に含めて記載するべきではないところ、当該工事を施工したとして当該工事の金額が鋼構造物工事の完成工事高に含まれるとする記載をした。
