株式会社田中建設の元代表取締役は、鹿角市が令和元年５月２１日に一般競争入札を執行した鹿角観光ふるさと館大規模改修工事（建築主体工事）に関し、前鹿角市長から工事価格及びその内訳の価格の教示を受け、同社に同工事を落札させ、もって偽計を用いて公の入札で契約を締結するためのものの公正を害すべき行為をしたとして、公契約関係競売入札妨害の罪により、令和４年７月２５日に秋田地方裁判所において懲役１年（執行猶予３年）の判決を受け、その刑が確定した。 このことが、建設業法第２８条第１項第２号に該当する。
